2C Tuesday, December 4, 2007 Visalia Times-Delta Judge revokes bail for financier in Cunningham case The Associated Press SAN DIEGO A federal judge revoked bail Monday for a key figure in the corruption case against former US. Rep. Randy "Duke" Cunningham after prosecutors accused him of committing bank fraud while freeonbaiL New York financier Thomas Kontogiannis appears to have continued "an illegal mortgage fraud scheme" while he await ed sentencing for laundering money from defense contractors to Cunningham, prosecutors said. He was free on $L5 million bond Washington Mutual Inc. purchased $50 million worth of fraudulent mortgages from Kontogiannis, prosecutors wrote the judge last week.

They didnt say when the alleged purchases occurred or elaborate on the circumstances. U.S. District judge Larry Bums ruled there was enough evidence that Kontogiannis "engaged in new and continuing crimes" to issue an arrest warrant for the financier, who is recovering from bypass surgery at a New York hospital. Kontogiannis' nephew and another defendant in the Cunningham case, John Michael, alerted the government that his uncle committed bank fraud while free on bail, and authorities obtained "clearer indications" of wrongdoing in the last two weeks, Jason Forge, an assistant US. attorney, wrote the judge last week.

Kontogiannis' attorney, Gregory O'Connell, said he was shocked by the government's most recent evidence and asked the judge for time to speak with his client The judge allowed Kontogiannis to stay in federal custody in New York until a hearing Dec 17. The surgery delayed Monday's sentencing for Kontogiannis, who pleaded guilty in February to laundering bribes to Cunningham from defense contractors Brent Wilkes and Mitch Wade. He faces a maximum sentence of 10 years in prison and $250,000 in fines. Burns questioned the timing of last week's surgery, which doctors had recommended for two years. "I think it's more than coincidental," the judge said.

Cunningham pleaded guilty in November 2005 to taking $14 million in bribes from defense contractors in exchange for millions of dollars in government contracts. The former San Diego lawmaker is now in federal prison serving a sentence of more than eight years. OBITUARIES OBITUARIES and Dcbra Hannig and her husband, Greg, Utah, his brother, Mac H.
